1. Definitions

• API: our web-based interface that provides vehicle and (chip)tuning-related information.
• Data: any information returned by the API, including vehicle specifications, original/tuned power and torque figures, images, metadata, and documentation.
• You / Customer: the individual or legal entity using the API, including your employees and contractors.

2. Informational nature of the Data (no warranty)

• The API and Data are provided for informational purposes only.
• We strive to keep Data accurate and up to date, but Data may be incomplete, outdated, or inaccurate.
• We make no warranties (express or implied) regarding the accuracy, completeness, availability, or fitness for a particular purpose of the API or Data.
• You acknowledge that performance figures (original/tuned) may vary in real-world conditions and do not constitute a guarantee of outcome.

3. No liability

• To the maximum extent permitted by law, we are not liable for any damages arising out of or related to your use of the API or Data.
• This includes indirect or consequential damages such as lost profits, lost revenue, business interruption, reputational harm, or loss of data.
• If we are found liable despite the above, our total liability is limited (to the extent permitted by law) to the fees you paid for the API in the one (1) month preceding the event giving rise to the claim.

4. Permitted use

You may use the API only:

• for your own internal business use or your own products/services,
• in compliance with these Terms, applicable laws, and any technical limits (including rate limits),
• without attempting to bypass authentication, authorization, or usage restrictions.

5. Prohibited use (scraping, abuse, resale)

You must not:

• Scrape, crawl, harvest, or bulk-download Data (including via headless browsers/bots) outside the intended API access patterns.
• Attempt to probe, scan, hack, reverse engineer, or otherwise compromise the API or related systems.
• Use the API in a manner that disrupts, overburdens, or materially harms our infrastructure.
• Resell, sublicense, rent, or redistribute the Data or API output to any third party, or build a competing dataset/service from the Data, unless we explicitly agree in writing.
• Share or publicly expose API keys or credentials.

6. API keys and security

• You are responsible for keeping your API keys and credentials confidential and secure.
• You must promptly notify us if you suspect unauthorized access or misuse.

7. Term, expiration, notifications, and suspension

• Your API access may have an expiration date as part of your subscription or agreement.
• When your expiration date is approaching, we may notify you by email using the address associated with your account.
• If the expiration date passes and we have not received payment/renewal, the API may be automatically suspended and may stop returning Data (in whole or in part).
• We are not responsible for any losses caused by expiration-based suspension or non-payment.

8. Monitoring and enforcement; termination for misuse

• We may monitor usage to ensure security, reliability, and compliance with these Terms (including detecting abuse and fraud).
• If we detect or reasonably suspect abuse, fraud, hacking attempts, scraping, or other violations, we may immediately suspend or terminate access and revoke API keys, without prior notice, where permitted by law.
• We may take additional steps as necessary to protect our systems and rights.

9. Availability and changes

• We do not guarantee uninterrupted availability of the API.
• We may modify endpoints, Data formats, features, and limits over time, including for maintenance or security reasons.

10. Intellectual property

• The API, documentation, branding, and the manner in which Data is provided are owned by us or our licensors.
• These Terms grant you a limited, non-exclusive, non-transferable right to use the API as described.

12. Governing law

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in Maastricht, unless mandatory law provides otherwise.
